Woman seeks more than $1 million after fall at Cleveland cabin

GALVESTON – A Brazoria County couple alleges the wife was injured in a fall at a cabin.

Katie Ann Poirrier and Travis J. Poirrier filed a complaint on Aug. 3 in the Galveston County District Court against Cynthia Elam Darwin, individually and doing business as Island Time Group; Connect Realty.com; Connect Realty Affiliates Inc., et al. alleging negligence and breach of the duty of care.

According to the complaint, Katie Ann Poirrier was an invitee at a cabin in Cleveland, Texas owned by Darwin and Roger Archie Sturgell and was injured in a fall down the exterior front stairs on Oct. 9, 2016. The suit states the stairs had been modified with risers that shortened the width of the steps in violation of state codes and the lighting that had been installed was on a timer and had switched off. The suit states she sustained a severe compound fracture to her right foot.

The plaintiffs request a trial by jury and seek monetary relief of more than $1 million and all further relief to which they may show themselves justly entitled. They are represented by Richard Warren Mithoff, Janie L. Jordan and Warner V. Hocker of Mithoff Law in Houston and John W. Miller of John W. Miller Attorney at Law in Lafayette, Louisiana.
