HOUSTON – A Houston grocer has been named in a suit by an employee who is seeking damages after suffering skull fractures in a fall.

Francisco Xum Guarchaj filed a complaint on Aug. 7 in the Harris County District Court against B & B Corner Corp., doing business as Hong Kong Food Market No. 4, et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 3, 2015, he was in the course and scope of his employment with the defendants and was severely injured when he fell from a ladder and landed on the concrete floor. The suit states he sustained injuries to his person and multiple skull fractures that resulted in medical expenses, physical and mental pain and loss of earning capacity.

The plaintiff holds B & B Corner Corp., doing business as Hong Kong Food Market No. 4, et al. responsible because the defendants allegedly failed to provide reasonably safe equipment, failed to provide proper training and supervision to perform his task safely and failed to provide workers' compensation benefits.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. He is represented by Jonathan C. Kieschnick of The Crim Law Firm PC in Houston.
