National Credit Systems alleged to have misrepresented status of purported debt

HOUSTON – A Harris County consumer alleges a debt collector is attempting to collect fees she does not owe.

Annisa Miller filed a complaint on Aug. 8 in the Harris County District Court against National Credit Systems Inc. alleging violation of the Texas Deceptive Trade Practices Act, the Federal Fair Debt Collection Act and other counts.

According to the complaint, the plaintiff alleges that on Aug. 8, 2016, she received a dunning letter from defendant attempting to collect a debt in the amount of $1,357.14, which she allegedly owed to an apartment complex that she left due to health issues. She alleges she disputed the debt and that the defendant responded in September that its investigation found the debt to be valid, which she alleges is false.

The plaintiff holds National Credit Systems Inc. responsible because the defendant allegedly misrepresented the character and status of the debt, used a false representation or deceptive means to collect the alleged debt and threatened to take an action that cannot be legally taken.

The plaintiff seeks all damages, plus interest, attorney's fees, costs and any further relief that is lawful and equitable. She is represented by Andrew E. Lemanski of Andrew E. Lemanski & Associates in Houston.
