HOUSTON – A Harris County man alleges he was injured by an unburied service line.
Darrell Petty filed a complaint on Aug. 14 in the Harris County District Court against Don Hatch Construction Inc. and Southwest Bell Telephone Co., doing business as AT&T Texas, alleging negligence.
According to the complaint, in November 2015, AT&T ran a service line at the plaintiff's residence and contracted Don Hatch Construction to bury the line. The plaintiff alleges that while he was walking to his mailbox, he tripped over the unburied service line and was injured.
The plaintiff holds Don Hatch Construction Inc. and Southwest Bell Telephone Co. responsible because the defendants allegedly failed to properly bury the service line and failed to provide warning sign of the existence of the tripping hazard they created.
The plaintiff requests a trial by jury and seeks judgment against defendants for his damages that may be proven at trial, pre- and post-judgment interest, costs of court and such other just and proper relief.
