Kemah individuals allege home, pool were not constructed with industry standards

GALVESTON – A Kemah couple alleges that a home and swimming pool they had constructed has defects.

John Carson and Lynda Carson filed a complaint on Aug. 22 in the Galveston County District Court against Michael D. Russell, individually and doing business as Preferred Pools of Houston Inc.; Matthew M. Murrell; Harbour Classic Builders LLC; and  Murphy Yates alleging that they violated the Texas Deceptive Trade Practices - Consumer Protection Act and negligence.

According to the complaint, the plaintiffs entered into a contract with Harbour in 2012 to construct a home and entered into another contract with Preferred in 2013 for the construction of a pool, deck and retaining walls.

The plaintiffs holds the defendants responsible because the defendants allegedly failed to construct plaintiffs' home and pool in accordance with the industry standards and the specifications outlined in the contracts and failed to repair damages.

The plaintiffs request a trial by jury and seek monetary relief of no less than $800,000 and such other and further relief to which they may be justly entitled. They are represented by Nicholas J. Lanza of Lanza Law Firm PC in Houston.
