Consumers allege they have been harassed with calls for Kia of South Austin

HOUSTON – Two Cedar Park consumers allege the joint owners and operators of Kia of South Austin have been harassing them with phone calls.

Jan Caraway and Bobby Caraway filed a complaint on Aug. 24 in the Houston Division of the Southern District of Texas against Group 1 Automotive Inc. and GPI TX-SKII Inc. alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that the defendants have been repeatedly calling them since 2013 for soliciting purposes. They allege their number is on the Do-Not-Call List and that they have never purchased a vehicle or had a business relationship with the defendants.

The plaintiffs holds Group 1 Automotive Inc. and GPI TX-SKII Inc. responsible because the defendants allegedly continued to place automated solicitation calls to plaintiffs’ residential telephone number using a prerecorded voice and without plaintiffs' prior express consent.

The plaintiffs request a trial by jury and seek statutory damages of $500 for each and every negligent violation and treble damages of up to $1,500 for each and every willful violation of the act and such other just and proper relief. They are represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
