GALVESTON – A man alleges he slipped and fell in a Walmart store and is seeking at least $200,000 in damages.

Isaac Ortiz filed a complaint on Sept. 5 in the Galveston County District Court against Wal-Mart Stores Texas LLC alleging negligence.

According to the complaint, the plaintiff alleges that on May 20, he was an invitee at defendant’s Wal-Mart store No. 3296 when he slipped and fell on a substance on the floor while shopping. The suit states the alcoholic beverage coolers were leaking water. He alleges he sustained significant injuries, pain and suffering, loss wages, mental anguish and medical expenses. 

The plaintiff holds Wal-Mart Stores Texas LLC responsible because the defendant allegedly failed to timely clean up the dangerous substance on the floor and failed to warn invitees of the existing hazard.

The plaintiff requests a trial by jury and seeks damages exceeding $200,000 but less than $1 million, pre- and post-judgment interests, costs of court and such other and further relief. He is represented by Sofia E. Bruera of Bruera Law Firm PLLC in Houston.
