Senior manager alleges the Rand Group terminated him days before surgery

HOUSTON – A Maryland man has filed suit against two Harris County companies over allegations he was terminated in retaliation for needing Family and Medical Leave Act leave.

Gerald Goforth filed a complaint on Sept. 9 in the Houston Division of the Southern District of Texas against The Rand Group LLC and Rand Group Solutions LLC citing the Family and Medical Leave Act and the Americans with Disabilities Act.

According to the complaint, the plaintiff was hired by the Rand Group in July 2013 as a senior manager. He alleges that on Oct. 1, 2015, three days prior to his rescheduled hip surgery, he was terminated from his employment at the age of 61. The suit states he was replaced by someone 10 years younger.

He alleges he has suffered loss of wages and benefits, emotional distress, humiliation, inconvenience and other pecuniary damages.

The plaintiff holds The Rand Group LLC and Rand Group Solutions LLC responsible because the defendants allegedly failed to make reasonable accommodation for him and that this was a motivating factor in the adverse employment actions.

The plaintiff requests a trial by jury and seeks actual and punitive damages, liquidated damages, reinstatement, front pay, attorneys’ fees, costs and such other and further relief. He is represented by G. Scott Fiddler and Andrew W. Reed of Fiddler & Associates PC in Houston.
