Woman accuses HTA Senior Care Portfolio 1 LLC, others of negligence after fall

By Philip Gonzales | Oct 4, 2017

BEAUMONT – A Port Arthur woman alleges she fell at a health care facility because of water on the floor.

Marilyn Kelly filed a complaint on Aug. 21 in the Jefferson County District Court against HTA Senior Care Portfolio 1 LLC, GE Healthcare Reit Senior Care Portfolio 1 LLC, et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 10, 2015, she sustained severe injuries when she fell at defendants' premises due to a large puddle of water on the floor. She alleges she sustained injuries to her neck, back and left knee and was caused to suffer medical expenses, lost earnings, pain and mental anguish.

The plaintiff holds HTA Senior Care Portfolio 1 LLC, GE Healthcare Reit Senior Care Portfolio 1 LLC, et al. responsible because the defendants allegedly failed to exercise ordinary care to reduce or eliminate a risk of harm.

The plaintiff requests a trial by jury and seeks monetary relief of more than $100,000 but less than $200,000 and such other relief to which she is entitled. She is represented by Jonathan C. Juhan and J.J. Bragg of Beaumont.
