SHERMAN – A Dallas consumer alleges that she has been harassed by phone calls made by Spectrum.
Tuwana Reaves filed a complaint on Sept. 14 in the Sherman District of the Eastern District of Texas against Spectrum, formerly known as Time Warner Cable Inc., alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in 2016, she began receiving defendant's calls to her cellular telephone. The plaintiff alleges that she incurred charges from her cellular telephone service provider for the calls and was harassed, annoyed and inconvenienced by the calls.
The plaintiff holds Spectrum responsible because the defendant allegedly continued to make calls using an automatic telephone dialing system and/or using an artificial or pre-recorded voice and without her prior express consent.
The plaintiff requests a trial by jury and seeks statutory damages of $500 for each negligent and treble damages of $1,500 for each willful violations and such other just and proper relief. She is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
