Shopper sues Wal-Mart over injuries from fall

GALVESTON — A customer at a Wal-Mart store is suing the company, alleging gross negligence as a result of injuries sustained in a fall.

Dana Stapleton filed a complaint on Sept. 29 in the Galveston County District Court against Wal-Mart Stores Texas LLC, alleging that the Arkansas corporation failed to maintain the premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Sept. 14, 2016, she was in the defendant’s Wal-Mart store in Conroe when she slipped and fell on a substance on the floor. She sustained significant injuries that resulted in physical and mental pain, medical expenses, loss of earning capacity, disfigurement and other exemplary damages, the complaint said. The plaintiff holds Wal-Mart Stores Texas LLC responsible because the defendant allegedly failed to timely clean up the dangerous substance on the floor and failed to warn its customers of the hazard.

The plaintiff requests a trial by jury and seeks monetary relief of between $200,000 and $1 million and all other relief she is entitled to. She is represented by Sofia E. Bruera of Bruera Law Firm PLLC in Houston.
