HOUSTON – A former server and bartender for a Houston establishment has filed a class action lawsuit over allegations that she and class members earned wages that were not paid.
Heather Irwin, individually and on behalf of all others similarly situated, filed a complaint on Oct. 11 in the Houston Division of the Southern District of Texas against Shamrock Pub LLC, Shamrock Pub Willowbrook and Ajan Corp. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that, during her employment with defendants from June 2016 to January, she was required to work in excess of 40 hours during many workweeks. She alleges she was paid a rate below the statutorily required minimum and was never paid any overtime pay. The suit states that the defendant also failed to provide a time keeping device to record the hours she actually worked.
The plaintiff also alleges she was terminated in retaliation for her complaints about these practices.
The plaintiff requests a trial by jury and seeks all unpaid wages, liquidated damages, attorney’s fees and costs, post-judgment interest and all other legal and equitable relief. She is represented by Joe Williams of The Law Offices of Joe M. Williams & Associates PLLC in Houston.
