Project superintendent alleges Mitchell Paint & Wallcovering Inc. terminated him in retaliation

HOUSTON – A Harris County man alleges he was terminated after he reported being injured on the job.

Sean Broz filed a complaint on Oct. 16 in the Harris County District Court against Mitchell Paint & Wallcovering Inc., doing business as Mitchell Contracting, alleging that the former employer violated the Texas Labor Code.

According to the complaint, the plaintiff alleges that in June 14, he was terminated from his employment with the defendant as a project superintendent. The suit states the plaintiff suffered a heat exhaustion injury the same day as a result of driving a company vehicle with an inoperable air conditioner and reported the injury to his supervisor.  He alleges he met with the defendant on July 18 and was offered his job back if he agreed to a reduction in salary, which the plaintiff refused. He alleges the reduced salary offer was in retaliation to him filing an injury report with the Texas Department of Insurance, Division of Worker's Compensation.

Also as a result of defendant's alleged refusal to provide insurance carrier information, the plaintiff claims he had to seek medical attention at his own expense and had to hire an attorney to prosecute his claim against defendant. 

The plaintiff requests a trial by jury and seeks actual, compensatory and punitive damages, attorney's fees, costs and any other relief to which he is entitled. He is represented by Elena H. Vlady of Law Office of Elena Vlady in Austin.
