Market Doctors Direct claims Carphoria owes more than $55,000 for kiosks

GALVESTON – An Alvin corporation is alleged to have failed to pay a Dickinson advertising and marketing business for leased kiosks.

Bailey Adventures LTD, doing business as Market Doctors Direct, filed a complaint on Oct. 31 in the Galveston County District Court against Carphoria LLC and Mike Dodd alleging breach of contract.

According to the complaint, in 2015 the plaintiff and defendant entered into an agreement for the defendant to market the plaintiff's digital advertising kiosks directly to auto dealers. The suit states the defendant agreed to pay the plaintiff a monthly amount for each dealer that leased a kiosk.

As of the filing of this petition, the amount of $55,732.47 allegedly remains due and owing. 

The plaintiff holds Carphoria LLC and Mike Dodd responsible because the defendants allegedly failed and refused to pay the full balance.

The plaintiff seeks judgment against defendants in the amount of at least $55,732.47, pre- and post-judgment interest, attorneys’ fees, costs and expenses and such other just and proper relief. It is represented by Lori Hood and Tiye Foley of Baker, Donelson, Bearman, Caldwell & Berkowitz PC in Houston.
