HOUSTON – A former driver for a nonemergency medical transportation service in Harris County alleges he is owed unpaid overtime wages.
Mitch George filed a complaint on Nov. 7 in the Houston Division of the Southern District of Texas against M&M Transit LLC and John McMiller alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between June 2016 and June 7, 2017, he routinely worked at least 45 hours per workweek for defendants without receiving overtime compensation for his work in excess of 40 hours per week. The suit states he was misclassified as an independent contractor.
The plaintiff holds M&M Transit LLC and John McMiller responsible because the defendants allegedly failed make a good faith effort to comply with the FLSA's overtime provisions.
The plaintiff requests a trial by jury and seeks unpaid overtime, liquidated damages, injunctive relief, declaratory relief, attorney’s fee and costs and such other just and proper relief. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
