BEAUMONT – A Jefferson County woman is seeking $1 million after driving into a canal in Beaumont.
Bevelynne Aclise filed a complaint on Oct. 27 in the Jefferson County District Court against the city of Beaumont, the Texas Department of Transportation and Texas Sterling Construction Co. alleging negligence, premises liability and other counts.
According to the complaint, the plaintiff alleges that on May 14, she was involved in a single-vehicle accident on Sienna Trails in Beaumont. She alleges that the road made an unmarked curve and that pavement continued into a canal. The suit states she drove into the canal and fractured both her ankles and was not discovered until the next morning.
The suit states at the time of the incident, the Texas Department of Transportation and Texas Sterling Construction Co. were working on a construction project that was approved by the city of Beaumont at the location.
The plaintiff holds the city of Beaumont, Texas Department of Transportation and Texas Sterling Construction Co. responsible because the defendants allegedly failed provide warning signs indicating the unexpected curve and failed to barricade or place another device to prevent a vehicle from entering the canal.
The plaintiff seeks monetary relief of more than $1 million, with interest and such other special and general relief. She is represented by Paul F. Ferguson Jr. of The Ferguson Law Firm LLP in Beaumont.
