HOUSTON – A patron of a Katy restaurant alleges he was injured when a piece of building material fell on his head while dining.
Robert McCrory filed a complaint on Nov. 16 in the Harris County District Court against Drix Restaurant Group LLC, doing business as Drix Wine Bar & Grill, alleging negligence.
According to the complaint, the plaintiff alleges that on July 27, 2016, he was injured while dining at defendant's restaurant when a large piece of crown molding fell on his head. He claims he sustained injuries and damages resulting in medical expenses, lost wages, pain and suffering mental anguish and disability.
The plaintiff holds Drix Restaurant Group LLC responsible because the defendant allegedly failed to correct the unreasonably dangerous condition created by the crown molding and failed to warn its invitees of the existence of such condition.
The plaintiff requests a trial by jury and seeks actual damages in excess of the jurisdictional limits of the court, pre- and post-judgment interest, costs of court and such other just and proper relief. He is represented by Jorge L. Gomez of Gomez Law Firm in Houston.
