CMC Management Team alleged to owe partner more than $16,000

HOUSTON – A business partner alleges a Harris County partnership and an individual failed to pay him in full.

Gilbert Rosales filed a complaint on Nov. 21 in the Harris County District Court against CMC Management Team and Carlos Lopez Caballero alleging breach of fiduciary duty, fraud and other counts.

According to the complaint, the plaintiff alleges that on Dec. 30, 2016, he provided a capital contribution to defendants' business in the amount of $23,000. The defendants agreed that the plaintiff would receive $1,533.33 per month beginning Feb. 1, 2017. After receiving payments for several months, the balance of $16,872.92 allegedly remains unpaid. 

The plaintiff requests a trial by jury and seeks actual damages of $16,872.92, exemplary damages, pre- and post-judgment interest, attorney's fees, costs and such other lawful and equitable relief. He is represented by Michael Gray Orlando of Orlando & Orlando LLP in Houston.
