Tenant files suit against Crosby property owner after fall allegedly caused by rotten stairs

HOUSTON – A Harris County woman alleges she was injured because of the dilapidated condition of the stairs at the rental property where she lived.

Luann Simon filed a complaint on Nov. 24 in the Harris County District Court against Ila Irwin alleging negligence.

According to the complaint, the plaintiff was a tenant at the defendant's Crosby property. She alleges on Oct. 2, she was walking down a set of stairs at defendant's property when she fell through the rotten stairs. She alleges she sustained serious injuries resulting in pain and suffering, medical expenses, loss of earning capacity and physical impairment and disfigurement. 

The plaintiff holds Irwin responsible because the defendant allegedly failed to inspect and correct the defective and dangerous condition and failed to inform invitees of the existing condition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and all other relief to which she is entitled. She is represented by Robert J. Freed and John A. Daspit of Daspit Law Firm in Houston.
