Registered nurse alleges The Right Solutions owes unpaid overtime wages

HOUSTON – A registered nurse claims a medical facility staffing company misclassified her as an independent contractor and not an employee.

Nena Brock, individually and on behalf of others similarly situated, filed a complaint on Feb. 1 in the Houston Division of the Southern District of Texas against The Right Solutions LLP alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff has been employed by the defendant since July 2002 and generally works 72 hours per week. She alleges that she did not receive proper overtime compensation for all hours worked in excess of 40 per week. 

The plaintiff holds The Right Solutions LLP responsible because the defendant allegedly misclassified its hourly paid nurses as independent contractors and refused to pay them overtime compensation at a rate of time-and-one-half as required by FLSA.

The plaintiff requests a trial by jury and seeks all unpaid overtime wages, liquidated damages, pre- and post-judgment interest, costs of court and all other just and equitable relief. She is represented by Todd Slobin and Ricardo J. Prieto of Shellist Lazarz Slobin LLP in Houston.
