HOUSTON – A Houston man alleges a construction company failed to pay him overtime wages.

Henson Russell filed a complaint on Feb. 20 in the Houston Division of the Southern District of Texas against Landry's Development Inc. alleging that the construction company violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between 2004 and November 2017, he worked for the defendant as a laborer. He alleges he worked more than 40 hours for one or more weeks during his employment.

The plaintiff holds Landry's Development Inc. responsible because the defendant allegedly failed to pay him at a rate of time-and-one-half times his regular rate of pay for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, attorneys’ fees, costs and expenses and such other relief as the court finds proper and equitable. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
