Product liability suit states ice cream shop worker cut herself using piece of machinery

HOUSTON – An ice cream shop employee has filed a lawsuit against Rockwell Automation after she allegedly injured herself using its Allen-Bradley PanelView Plus 600.

Raquel Rojas Huerta’s suit, which was filed on Feb. 28 in the Harris County 269th District Court, states that the La Brisa Ice Cream Factory worker severed her right middle thumb finger when the piece of machinery “ignited itself” without warning on Apr. 27, 2016.

The plaintiff was reportedly attempting to extract jammed wrapping paper at the time of the subject event.

“The product was defectively designed and unreasonably dangerous in that the blade view Plus component turned on while the plaintiff was removing ice cream rapped (sic) paper,” recent court documents say.

Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.

She is represented by Celestine C. Ude of the Celestine Ude Law Firm in Houston.
