HOUSTON – A Montgomery County man alleges his former employer owes him more than $2,000 in unpaid overtime wages.
Kenneth Platter filed a complaint on March 8 in the Houston Division of the Southern District of Texas against Advertising Higher Inc. and Ron Francois alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during one or more weeks of his employment with defendants from 2012 to Aug. 27, 2017, he worked in excess of 40 hours per week without receiving overtime pay.
The plaintiff holds Advertising Higher Inc. and Francois responsible because the defendants allegedly failed to compensate him at a rate of no less than one-and-one-half times his regular rate of pay for each hour worked in excess of 40 in a workweek.
The plaintiff requests a trial by jury and seeks overtime wages of $2,022.64, plus an equal amount for liquidated damages, attorneys' fees and costs, prejudgment interest, and such other lawful and equitable relief. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
