Sales manager seeks declaration regarding agreement with Premier Polymers

HOUSTON – A Harris County man is seeking declaration regarding an agreement with his former employer.

Michael Reilly filed a complaint on March 13 in the Harris County District Court against Premier Polymers LLC seeking declaratory judgment.

According to the complaint, the plaintiff resigned his employment with the defendant in May 2017 and began working for Genesis Polymers as a regional sales manager. He alleges he was an at-will employee for the defendant and signed a confidentiality and nonsolicitation agreement.

The suit states the defendant has sent the plaintiff a letter to remind him of his alleged obligations under the agreement, but the plaintiff alleges it is not enforceable because it does not contain reasonable limitations regarding time, area and scope of activity and other items.

The plaintiff seeks monetary relief of more than $100,000 but less than $200,000 and judgment that paragraphs in the agreement are not enforceable. He is represented by Michael A. Ackal III, Gabe T. Vick and Jonathan M. Hyman of Gray Reed & McGraw LLP in Houston.
