Busser seeks damages from IHOP operator after falling from chair

HOUSTON – A busser at a Houston restaurant alleges she was injured on the job because she was exposed to an unsafe condition.

Rosa Lopez filed a complaint on March 22 in the Harris County District Court against Mas Amin 1336 Inc., doing business as IHOP No. 1336, alleging exposure to an unsafe condition on the premises.

According to the complaint, the plaintiff alleges that on Jan. 23, 2017, she suffered injuries while working for defendant in one of its restaurants when she fell while cleaning an overhead filter. She alleges there were no ladders in the restaurant and she was told to stand on a chair. She alleges the chair's legs slid and caused her to fall to the floor.

The plaintiff holds Mas Amin 1336 Inc. responsible because the restaurant's manager allegedly exposed her to unsafe work condition by instructing her to do a task that was not in the course and scope of her employment.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other relief to which she is entitled. She is represented by Carlos A. Leon and Piero A. Garcia of The Leon Law Firm PC in Sugar Land.
