Consumer claims he was never served with complaint referenced in American Credit Financial voicemail

SHERMAN – A Plano consumer alleges a debt company implied that it had filed a complaint against him in a voicemail.

Zohaib Mohammed filed a complaint on April 2 in the Sherman District of the Eastern District of Texas against American Credit Financial LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 12, the defendant called plaintiff to collect on an allegedly past-due loan and left a voicemail message. He alleges he disputes the debt and that the voicemail stated that he was going to be served with a complaint. He alleges he was never served, and that the defendant also falsely accused him of writing a bad check.

The plaintiff holds American Credit Financial LLC responsible because the defendant allegedly failed to identify the name of the debt collector and failed to disclose that the communication is from a debt collector.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorneys’ fees, costs and expenses and all other appropriate relief. He is represented by Keren E. Gesund of Gesund & Pailet LLC in Plano.
