HOUSTON – A Florida woman alleges her adult son is now a spastic triplegic as a result of a heart transplant at a Houston hospital.
Catherine Keys Jackson, individually and as next friend of Ernest Keys, an incapacitated adult filed a complaint on June 14 in the Harris County District Court against Chi St. Luke's Health Baylor College of Medicine Medical Center, et al. alleging negligence.
According to the complaint, on June 25, 2016, Ernest Keys underwent a heart transplant performed by defendants. As a result of their alleged negligence, the suit states he suffered an hypoxic ischemic encephalopathy brain injury shortly after the procedure and is now a spastic triplegic who cannot speak and is severely disabled.
The plaintiffs hold Chi St. Luke's Health Baylor College of Medicine Medical Center, et al. responsible because the defendants allegedly failed to take precautions to prevent injuries, failed to insert circulatory support devices during surgery and failed to timely treat his right-sided heart failure.
The plaintiffs request a trial by jury and seek actual damages, plus interest, costs of court, and such other and further relief to which they may show themselves justly entitled. They are represented by Linda Laurent Thomas and Michelle W. Wan of Thomas & Wan LLP in Houston.
