HOUSTON – A former flowback operator for two companies alleges that he and other employees were not paid for overtime work.
Coye Baker, individually and on behalf of all others similarly situated, filed a complaint on Oct. 26 in the Houston Division of the Southern District of Texas against Rockwater Energy Solutions Inc. and Titan Test Pumps LLC alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between November 2016 and February 2017, he was employed by the defendants as an oilfield contractor/flowback operator and did not receive overtime compensation for all hours worked over 40 hours per week. He alleges he typically worked 12-hour shifts for sometimes seven days a week.
The plaintiff holds Rockwater Energy Solutions Inc. and Titan Test Pumps LLC responsible because the defendants allegedly improperly misclassified employees as independent contractors and paid them on a day-rate basis with no overtime pay at a rate of time-and-one-half of their regular hourly wage rate.
The plaintiff requests a trial by jury and seeks an order permitting this action to proceed as a collective action and appointing plaintiff and his counsel to represent the class, award for all unpaid overtime compensation, liquidated damages, attorneys’ fees, costs, interest and such other and further relief as may be necessary.
