HOUSTON – A Katy man alleges he was not informed of problems with a property's plumbing and water system before he purchased it.

Michael Melville filed a complaint on Jan. 7 in the Harris County District Court against Rustic Knolls Investments and Thisislivin Properties LLC alleging negligence, common law fraud and other counts.

According to the complaint, the plaintiff alleges that on Jan. 6, 2016, he closed on a real estate transaction for a property Park Royale Drive in Katy. He alleges the defendants misrepresented that the plumbing and water system in the home was in compliance and that the home was in a safe and habitable condition before closing.

The plaintiff alleges there is mold in the water system as a result of faulty plumbing and that the plumbing and piping system is out of compliance and illegal. He alleges the defendants have refused to cure the defects.

The plaintiff holds Rustic Knolls Investments and Thisislivin Properties LLC responsible because the defendants allegedly concealed or failed to disclose material facts within their knowledge.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and such other and further relief to which he may be justly entitled. He is represented by Vy Nguyen of The Law Office of Vy Nguyen PLLC in Houston.
