Mother pursues legal action in child's beach drowning death

GALVESTON – A wrongful death lawsuit has implicated a local social services organization in the recent beach drowning death of a child, recent Galveston County District Court records show.

Ashley Garner brought the suit against The Children’s Center, Inc. on Feb. 12 in the Galveston County 405th District Court in response to the Oct. 14, 2018 incident which occurred on the beach near 17th Street in Galveston.

The defendant reportedly brought N.G., the young decedent, and several other minor children to the beach near 17th Street in Galveston. One of the children was caught in a rip current and N.G. was prompted “to dive into the water in an effort” to rescue, the original petition says.

According to the suit, N.G. “was also caught in the rip current and disappeared along with one other minor child.”

Garner insinuates that the defendant ignored a red flag raised by the Galveston Island Beach Patrol at the time. Per the beach patrol’s Web site, the red flag cautions beachgoers that “conditions are determined to be out of the ordinary, such as the presence of strong wind, strong current or large surf.”

Consequently, the complainant seeks unspecified monetary damages.

She is represented by the law firm Gibson Hill, P.C. in Houston.
