According to the complaint, on July 11, 2018, the plaintiffs were in their vehicle at a complete stop on Huffsmith Korhrville Road in Tomball. The suit says Small, who was operating a cement truck owned by Cemex, failed to stop quickly enough and collided with the plaintiffs' vehicle.

The plaintiffs allege they sustained serious personal injuries because Small failed to keep proper lookout, failed to apply the brakes and made an unsafe lame change.
