Contractor accuses demolition team of false charges

HOUSTON — A contractor is suing a Harris County demolition team, alleging the plaintiff was falsely accused of not paying the demolition crew for work it did not complete.

Matthew Date filed a complaint April 23 in the Harris County District Court against LBR Construction and Gustavo Reyes, alleging fraud.

According to the complaint, Date was hired to perform restoration work June 14, 2018, for property at 15326 Maple Meadows Drive, Cypress. The plaintiff and defendants agreed that LBR Construction would perform demolition work for $16,000. 

The suit says the defendant did a portion of the work but then demanded $145,000 to complete the project. The plaintiff says he did not pay the defendant the amount it asked for, but did pay LBR Construction $20,000 for the work it performed and then terminated the relationship. 

The defendant, the suit says, has filed a lien on the property, alleging it is still owed $125,000.

Date seeks trial by jury, actual damages, $10,000 as well as damages up to $433,750, court costs, attorney fees, interest and all other fit relief. He is represented by attorneys William D. Abbott and Les Pickett of Galloway, Johnson, Tompkins, Burr & Smith in Houston.
