Harris County couple alleges law firm failed to represent them fairly

HOUSTON — A Harris County couple is suing a Houston law firm, alleging that they were not represented fairly.

Yvonne Stoneham and Charles Stoneham filed a complaint May 6 in Harris County District Court against Cheryl Irvin and The Irvin Law Firm PLLC, alleging negligence and breach in the standard of legal care.

According to the complaint Yvonne Stoneham was shopping at Lowe's, on Oct 2, 2016 with her husband. The plaintiff alleges she was tripped by a protruding rake, causing her to fall on her knee and sustain pain and suffering and costs for medical care. The suit says Charles Stoneham suffered loss of consortium. 

The suit alleges Lowe's had a responsibility to ensure that Yvonne Stoneham remain safe, but she ended up requiring surgery. The Irvin Law Firm represented the plaintiffs in a case against Lowe's, and the Stonehams signed a contingency-fee attorney-client agreement Dec. 6, 2017. 

The plaintiffs allege the defendant took no steps to serve Lowe's with a process within the statute of limitations. Yvonne Stoneham says she has continued to seek a status update of her case but Lowe's has not been served yet, constituting a breach in the standard of legal care.

The Stonehams seeks trial by jury, actual damages, interest, court costs and other just relief.  They are represented by attorney Jeff M. Meyerson and Ard Ardalan of The Meyerson Law Firm PC in Austin.
