Harris County woman alleges assault, false imprisonment

HOUSTON — A Harris County woman is suing two others, alleging she was assaulted and falsely imprisoned despite doing no wrong.

Rosaly Canales filed a complaint July 9 in Harris County District Court against Joanna Malach and Seaborn Gardner Eastland, alleging assault, conspiracy and malicious prosecution.

According to the complaint, Canales was struck by Malach on April 7, 2018, with a blunt instrument, causing her to fall to the ground. The plaintiff alleges that she was assaulted because she had accidentally interfered with Malach's sleep when she arrived at her worksite at 2 a.m. 

The plaintiff says she called 911 but when Houston police officers arrived they arrested Canales upon altered facts. She alleges she was held in jail for a number of days before being released and seeking treatment at Memorial Hermann First Colony in Sugar Land.

Canales, who alleges all charges were dismissed by the Harris County District Attorney's Office, says during this time, Malach was instructed and directed by e-mails from Eastland on how to wrongfully prosecute the plaintiff.

Canales seeks trial by jury, attorney fees, court costs, interest and all just relief. She is represented by attonrey William M. Walls of Houston.
