HEB supermarket customer alleges negligence caused fall on spilled milk

HOUSTON — HEB supermarkets faces a negligence lawsuit filed by a Houston customer who slipped on spilled milk near the checkout and injured her hands, knee, foot and back.

Faith Johnson filed a complaint  Oct. 24 in the Harris County District Court against HEB LP and HEB Inc., alleging negligence.

According to the complaint, on Nov. 1, 2018, Johnson was at the HEB Mi Tienda store on Little York Road in Houston when she slipped and fell on "a spill of milk" near the checkout area. She alleges the liquid spill was directly next to a cashier "who knew or should have know about the liquid while completing her cleanup, inspection of her counter, and replacement of unpurchased goods left at the counter, in between checking out customers."

The plaintiff said "....they failed to properly and reasonably, secure the area where the spill occurred and to foresee the danger that a spill would pose to its invitees. "

The plaintiff alleges the fall caused her to strike her hands. knee and foot on the floor and seriously injure her back. The suit alleges the injuries led to nearly $55,000 in medical expenses, mental anguish and loss of enjoyment of life.

Johnson seeks monetary relief in excess of $100,000, attorney fees, court costs and all equitable relief. She is represented by attorney Prudence Smith of The Smith Law Firm in Houston.
