Patient alleges Pasadena dentist left piece of instrument in her tooth

HOUSTON — A Pasadena dentist faces a lawsuit after a patient alleged a piece of metal instrument was left in her tooth during a root canal causing her to suffer sinus pain, infection and foul taste. 

Velma Boyer filed a complaint  Nov. 26 in Harris County District Court against Dr. Jose Rivera-Gautier, Texas Dental Associates PA, doing business as Lovett Dental, Participant Dental Services LLC, doing business as Lovett Dental, Lovett Dental - Pasadena and Lovett Dental, alleging negligence and gross negligence, intentional infliction of emotional distress, violation of the Texas Deceptive Trade Practices Act and conspiracy. 

According to her complaint, Boyer underwent a root canal Nov. 28, 2017, with Rivera-Gautier. She alleges the dentist broke off a piece of metal instrument that was in her tooth and also left root canal "obturation material" at the tip of her tooth. 

Boyer also says Rivera-Gautier and his staff then tried to cover up the alleged mistakes, which were clearly visible on her x-rays. She alleges she suffered pain, sinus discharge and "putrid stench and taste."

Boyer seeks monetary relief, interest and all other just relief. She is represented by Timothy Soefje of Seltzer Chadwick Soefje & Ladik PLLC in Frisco.
