Harris County couple accuse property inspector of negligence after discovering leaks, mold in home

HOUSTON – A Harris County accused a property inspector they hired prior to purchasing their home failed to find roof leaks and mold that were discovered after their purchase. 

Matthew Daniels and Vanessa Daniels filed a complaint Dec. 17 in the Harris County District Court against Dwight Rutledge, doing business as Rutledge 7 Associates, alleging negligence and breach of contract.

The Daniels' hired Rutledge, a licensed professional inspector, prior to their purchase of a property in Baytown on Dec. 15, 2017. They allege in their complaint that after purchasing the property on Jan. 25, 2018, they discovered the home had leaks in the roof and a "significant presence" of mold. They claim Rutledge performed an "inadequate amount of time" in his inspection and failed to discover and report the leaks. 

The Daniels' seek monetary relief between $200,000 and $1 million, trial by jury, interest and all other just relief. They are represented by Dennis Albright and Kathryn Lumpkin of Albright & Lumpkin PC in Houston.
