Texas woman sues for slip and fall at Sears

A Texas woman is suing Sears Roebuck and Co. and Kellermeyer Bergensons Services, LLC alleging negligence in a slip and fall.

The plaintiff Barbara Gillis filed suit on Sept. 23, 2015 against the defendants in the District Court of Jefferson County.

According to the case, the Gillis was shopping in the houseware section at the Sears Roebuck on or about Jan. 26. The other defendant in the case, Kellermeyer, was responsible for cleaning the floors at the location, but failed to put up any wet floor signs in an area where there was a standing puddle of water on the floor. 

As a result, the plaintiff slipped, fell, and injured her back, her right foot, and her body in general.

The defendants are accused of breach of duty, being that they did not use ordinary care to warn of dangerous conditions on the premises. 

Since they failed to inspect the area where there was standing water in the walkway, the plaintiff is suing for damages including physical pain and suffering, mental anguish, physical impairment, as well as past and future medical expenses.

The plaintiff was represented by the Bernsen Law Firm in Beumont, Texas.
