SHERMAN —  A Dallas automobile leasing company is facing a suit filed by a Texas consumer who alleges he was fraudulently sold a car without the safety features he required due to his disability.

Charles Jerger filed a complaint  April 13 in the Sherman Division of the Eastern District of Texas against D&M Leasing Dallas and Ally Financial Inc., alleging violation of the Truth in Lending Act, fraud, negligence, and other claims.

Jerger went to D&M on April 12, 2019, in order to exchange his leased 2011 Lexus. He alleges the dealership refused to give him any paperwork on a sale and was falsely told the vehicle had the required safety features he needed due to his disability such as front and backup cameras.  Jerger claims he was also told he could take the car home for a few days to "try it out" but after returning to D&M with the car, he was told the sale was final.

Jerger seeks monetary relief, trial by jury, interest and all other appropriate relief. He is represented by Lisbeth Findsen of The Price Law Group in Scottsdale, Arizona.
