Customer alleges puddle of water at Houston food store caused her slip, fall

HOUSTON — A customer who slipped on a puddle of water at a food store in Houston is claiming premises liability. 

Bertha Castillo filed a complaint Sept. 27 in Harris County District Court against Lewis Food Town Inc., alleging premises liability. 

Castillo alleges in her complaint that she was at the defendant's store on West Sam Houston Parkway South in Houston on June 25, 2021. She claims she slipped and fell on a puddle of water near the cart area and suffered injuries. Castillo alleges the defendant failed to inspect and make the dangerous condition safe, failed to provide a safe means of ingress and egress for its patrons and failed to properly train its employees. 

She also alleges the defendants are liable for failing to warn of the dangerous condition and for not maintaining a regular maintenance schedule or cleaning regimen. Castillo claims as a result of her slip and fall, she suffered pain, disability, loss of earnings and incurred medical expenses. 

Castillo seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Christopher Bertini of Higdon Lawyers in Bellaire.
