Cleaning crew member sues McDonald's alleging loose door knob caused her fall

HOUSTON — A cleaning crew member alleges an unsecured, loose door knob at a Houston McDonald's caused her to fall and suffer injuries. 

Graciela Arizpe filed a complaint Sept. 26 in Harris County District Court against H.K. Smith Management Inc., doing business as McDonald's Restaurant #26850 alleging negligence. 

Arizpe, according to her complaint, was working to clean the defendant's McDonald's restaurant on North Sam Houston Parkway East in Houston on Oct. 3, 2020. She claims that as she pulled on a door handle in the back of the restaurant, the handle broke off and caused her to fall back, strike her head and suffer serious injuries. 

Arizpe alleges the door handle was loose and unsecured and that the defendant negligently failed to inspect the door to make sure it did not create a hazard. She also alleges the defendant was negligent for not replacing the door handle or warn of the hazard. Arizpe claims as a result of the loose door handle, she suffered pain, impairment, mental anguish and incurred medical expenses. 

Arizpe seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Kevin Bush and Jonathan Simon of The Simon Law Firm in Houston.
