Tenant alleges she was robbed due to landlord giving apartment key fob access

HOUSTON — A tenant alleges her landlord created, activated and handed a newly programmed key fob for her apartment to a complete stranger who then robbed her while she was out of town. 

Brandi Dorsey filed a complaint Oct. 3 in Harris County District Court against Bowen River Oaks and Quarterra Living LLC alleging negligence and breach of contract. 

Dorsey, according to her complaint, was a resident of Bowen River Oaks in the River Oaks neighborhood in Houston. She claims that a new electronic key fob was programmed to her unit on Sept. 10, 2022, and that she was out of town during this time and did not request the creation of the new key fob. Dorsey alleges the defendant gave a stranger the newly programmed key fob who then accessed her home and stole "nearly every piece of furniture, electronics, clothing, accessories, cookware, dishes" as well as sentimental items. 

She claims the defendant's negligence for failing to take adequate security precautions, control access to the premises or provide security personnel. Dorsey further claims the defendant failed to maintain the premises in a secure manner, failed to properly train and supervise its employees or warn that they gave a stranger access to her apartment. 

Dorsey seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Kimberly Daily of K&L PLLC in Cypress.
