Landlord sues commercial tenant over subtenant's damage to property

GALVESTON — A commercial tenant is facing a claim after their subtenant caused significant damage to the property including smashing windows and knocking holes into walls and doors. 

Es & Dye and John Collins filed a complaint June 6 in Galveston County District Court against Watermans Marina LLC and Todd Edwards alleging breach of duty and other claims. 

According to the plaintiffs' complaint, Watermans lease agreement for a property on Concho Key in Galveston was terminated on March 15, 2023, due to failure to pay rent. They further claim that on March 28 and March 29, 2023, Watermans subtenant Larry Collie, punched, knocked and broke holes into the walls, doors and windows of the premises with a hammer. 

The plaintiffs allege they filed an eviction notice on May 1, 2023 and were granted a writ of possession on May 10, 2023. They claim the defendants had a duty to prevent and repair any damage to the premises and that Collie had known "unpredictable and malicious tendencies" yet they allowed him to sublease the property.  

The plaintiffs seek monetary relief of $250,000 or less, interest and all other just relief. They are represented by Attorney Trey Lavespere in Texas City.
