New Creation Concrete Paving named in breach of contract lawsuit

HOUSTON – Spring homeowners have filed a breach of contract lawsuit against New Creation Concrete Paving, claiming that the company failed to complete a driveway and sidewalk project despite being paid to do so. 

Plaintiffs John and Virginia Leggett filed the lawsuit in the Harris County District Court against New Creation Concrete Paving, citing breach of contract in violation of the Texas Deceptive Trade Practices-Consumer Protection Act.

According to the lawsuit, on June 24, 2021, the plaintiffs entered into a contract with New Creation Concrete Paving for the construction of a new concrete driveway and sidewalk at the plaintiff's residence in Spring, TX.

The plaintiffs allege that they paid the defendant the sum owed to complete the project, but despite their payment, the defendant has breached the contract by failing to construct the driveway and sidewalk as required in the contract.

The plaintiffs are seeking damages for an amount in excess of $250,000, but not more than $1,000,000, plus interest, court costs, attorneys fees, and any other relief the court deems proper. They are represented in this case by attorney Dan Ducote, Jr., of Moore Landry, LLP, in Beaumont.
