Individual sues Berry Companies, Inc. after employee allegedly dropped heavy equipment on his arm

HOUSTON – A worker has filed a lawsuit against Berry Companies, Inc., claiming that he was injured when an employee carelessly dropped heavy equipment on his arm.

Plaintiff Oscar Ochoa, Jr. filed the lawsuit in the Harris County Circuit Court against Berry Companies, Inc., citing negligence.

According to the lawsuit, on July 17, 2023, Ochoa was an invitee of Berry Companies to be on the company's premises. The lawsuit states that while Ochoa was on the premises, an employee of the defendant was loading equipment on Ochoa's trailer when the employee suddenly and without warning dropped the loading portion of the equipment onto Ochoa's arm, causing him serious injury.

Ochoa claims that the defendant was negligent in its failure to properly train its employee in the use of equipment, failing to properly supervise its employee, failing to provide sufficient manpower to complete the task, and negligence in general.

Ochoa alleges that as a result of the defendant's negligence, he has sustained severe injuries, which have caused him to experience pain, suffering, disability, mental anguish, and lost wages. He alleges his injuries will affect his ability to earn income and enjoy daily life, and he adds that he has incurred medical costs and will continue to require the services of medical staff to recover.

The plaintiff is demanding a jury trial to seek damages in excess of $50,000, but not more than $1,000,000, plus court costs, interest, and any other relief the court deems proper. He is represented in this case by attorney Richard "Trey" Barton, III, of the Law Office of Richard L. Barton, III, PLLC, in Houston.
