Negligence lawsuit filed against The Shops at Memorial Heights following patron's injury on defendant's property

A Harris County woman has filed a negligence lawsuit against The Shops at Memorial Heights, alleging that she was injured when she tripped and fell on uneven ground at the defendant's Houston property. 

Plaintiff Kathy Gracia filed the lawsuit in the Harris County District Court against The Shops at Memorial Heights, Memorial Heights Shops Limited, Blex Exchange II LP, and Across Asset Management, Inc., citing negligence.

According to the lawsuit, on April 25, 2023, Gracia was an invitee to a Houston property owned and maintained a property located in Houston. Gracia claims that while she was on the premises, she stepped on some uneven ground and fell, injuring herself.

According to the Gracia, the defendants had a responsibility to maintain the premises to protect the safety of their patrons and should have been aware of the dangerous conditions in the area. Despite this, the defendants negligently failed to address the dangerous condition and allowed it to exist at risk to their patrons while also failing to provide warning of the hazard.

Gracia claims to have sustained bodily injuries that have caused her to experience pain, suffering, mental anguish, physical impairment, disfigurement, and lost wages. She says that her injuries will affect her ability to earn income and that she has incurred medical expenses and will continue to require the services of medical staff to recover from her injuries

The plaintiff is seeking damages in an amount not more than $1,000,000, plus interest, court costs and any other relief the court deems proper. She is represented in this case by attorneys James M. Lassiter, Timothy M. Mchale and Mohammed Nabulsi of the Lassiter Law Firm in Houston.
