HOUSTON - A hailstorm lawsuit has been brought against the Lemonade Insurance Company.
Alleging noncompliance with the Texas Insurance Code, Charles and Evelyn filed the suit on Oct. 19 in Harris County District Court.
According to the lawsuit, on Sept. 7, 2022, the plaintiffs’ property sustained serious structural damage as a result of a severe wind/hail storm. After the plaintiffs made a claim, the defendant assigned a local adjuster who allegedly failed to adequately adjust the claim, which resulted in underpayment.
After having the damages reevaluated by a qualified contractor, the plaintiffs sent the defendant a demand for payment.
“Defendant has wrongfully delayed and denied payment of the balance due to plaintiff for claim,” the suit states.
The plaintiffs are seeking actual and exemplary damages.
