Shopper files negligence lawsuit against Pasadena 99 Cents Only Store after slip-and-fall injury

HOUSTON – A shopper is suing a 99 Cents Only Store in Pasadena for damages after she allegedly fell and injured herself in the store.

Plaintiff Betty Barrientos filed the lawsuit in Harris County District Court against 99 Cents Only Stores and 99 Cents Only Stores Texas, citing allegations of negligence.

According to the lawsuit, Barrientos was a patron at a 99 Cents Only Store in Pasadena on December 14, 2021. She claims that while she was shopping, she slipped on a slippery substance and fell, severely injuring herself. Barrientos contends that the store was notified of the dangerous condition of the store but failed to clean up the substance before Barrientos slipped and fell.

Barrientos states that the defendant failed to properly maintain the premises to protect the safety of its customers and cites various forms of negligence, including failure to provide warning of the substance and failure to clean up the substance.

Barrientos alleges she sustained bodily injuries and is seeking damages for pain, suffering, mental anguish, loss of earnings, physical impairment, disfigurement and medical expenses, plus interest, court costs and any other relief the court deems proper.

The plaintiff is represented by attorneys Davis K. Mestemaker, Norman Straub and Jonathan B. Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
