Fiesta Mart employee sues after box she was trying to reach falls on her

HOUSTON - A woman is suing Fiesta Mart for injuries she allegedly received when a box she was attempting to retrieve fell on her. 

Seeking up to $1 million in damages, Edelmira Finney-Torres filed her suit on Jan. 29 in Harris County District Court, also naming Mirna Rodriguez as a defendant. 

According to her lawsuit, on April 4, 2022, Finney-Torres was working in the bakery station at a Houston Fiesta Mart. Rodriguez was the store manager at that time. 

In her suit, Finney-Torres says she entered the supply room to retrieve an item for a customer that was located in a box on the top shelf. 

“There was no ladder or step stool located in the supply room,” the suit states. “As Plaintiff attempted to retrieve the box, the box fell on Plaintiff and caused… serious bodily injuries. It is believed that the box weighed approximately 50 pounds.” 

The suit accuses the defendants of negligently failing to supervise and train its employees and failing to provide the proper equipment. 

Finney-Torres is suing for her medical expenses, pain, impairment, disfigurement and lost wages.
