Trip & fall suit alleges floor with was not level with doorstep exit

HOUSTON - A trip and fall lawsuit seeking more than $1 million damages is alleging that the floor was not level with a doorstep exit, creating a dangerous condition. 

Alleging premises liability, Ildefonso Herazo filed suit against Lovett Commercial, 401 Franklin Street and David Harvey Builders on Feb. 5 in Harris County District Court. 

According to the lawsuit, on Aug. 2, 2022, Herzo was walking around the Post Houston building, which was undergoing renovations, and entered Lovett’s to look around and take pictures. 

After walking around for a few hours with his children, he decided to go and walked toward the exit door. As he stepped onto the other side of the door, he fell to the ground on his left knee. 

“After falling to the ground, Plaintiff Herazo realized that the floor on the other side of the door was not level with the doorstep exit,” the suit states, adding that the defendants failed to correct the dangerous condition and failed to warn of its nonobvious existence.

Herazo is represented by attorneys Mariliza Williams and Alfonso Nevarez of the  Nevarez Williams law firm.
